1.  Generally

1.1. Bodrum Express Lines Denizcilik Tic. Ltd. Sti. (“Allferrys”) provides a platform for ferry ticket sales via the www.allferrys.com domain website (“Website”) and the mobile application of Allferrys (“Mobile Application”).

1.2. Please read this page whenever you visit Allferrys or want to purchase tickets. From your first visit to Allferrys, you are deemed to have fully understood and accepted as an integral whole the matters written below, which contain important information about visiting and/or using the Platform.

1.3. These Ferry Terms of Use are inseparable with other explanations, policies and rules on the Platform.

2.        Parties and Subject

2.1. These Ferry Terms of Use are valid for everyone who visits the Platform, buys tickets and/or becomes a member. Within the scope of the Ferry Terms of Use, the term "User" refers to all persons who purchase a ferry ticket as a member of the Platform ("Member") or who purchase a ferry ticket ("Visitor") by simply visiting the Platform.

2.2. The owner of the platform is Bodrum Express Lines Denizcilik Tic. Ltd. Sti. titled company. Platform services offered through the Platform are provided by Allferrys. In this context, “Service”; Refers to the user's purchase of tickets through Allferrys.

2.3. The transportation service for ferry tickets offered for sale on the Platform is clearly stated in the section where the relevant ticket is purchased on the Platform, and Allferrys has no responsibility for the provision of such service. Allferrys, which acts as an Intermediary Service Provider and mediates the establishment of distance contracts within the scope of the Law on the Protection of the Consumer No. 6502 and the Law on the Regulation of Electronic Commerce No. 6563, has no liability regarding the time of departure and/or similar content provided by the carrier companies.

2.4. These Ferry Terms of Use have the character of a contract and the subject of the contract is the sale of ferry passenger transport tickets. It consists of the sales price of the ticket, payment method, departure terminal, arrival terminal, flight date, departure time, information at the time the order is terminated and is also sent to the e-mail address of the Users. 3.        Provisions

3.1. Allferrys has the right to change the information, forms, content of any kind and these Ferry Terms of Use on the Platform at any time, without further notice.

3.2. All content, brands and logos created by Allferrys, including but not limited to the Platform's design, image, html code, are the property of Allferrys. Users cannot use, share, distribute, exhibit, reproduce, or create derivative works from the products subject to Allferrys' intellectual and/or industrial property rights.

3.3. In order to comply with the obligations imposed on it pursuant to other applicable legislation, in particular the Law No. 5651 on Regulating Broadcasts Made on the Internet and Combating Crimes Committed Through These Broadcasts, Allferrys may record the records specified in the relevant legislation regarding any transaction performed by the Users within the legal period. and it can be stored. These processes may include the time and duration of the visit, the pages viewed and the information of the site visited before coming to the Platform. This information is only used to measure Platform activity and generate ideas to improve the Platform. The Platform is accessible to all Users.

3.4. Users agree that they will not reproduce, copy, distribute, process any content on the Platform, including electronic text, visual and audio images, video clips, files, databases, catalogs and lists, directly with Allferrys, either by these actions or by any other means. and/or indirectly, that they will not enter into competition. In this context, it is prohibited to copy, reproduce, transmit, process and display the contents and interface on other websites and/or media without the written consent of Allferrys. Any content accessed and/or viewed through the platform cannot be used or viewed by third parties in any medium, especially on the internet, without the prior and written consent of Allferrys; otherwise, it will constitute an unlawful use.

3.5. Access to the database where the content accessed and/or viewed through the platform is stored by third parties only for the purpose of displaying the relevant content and/or as permitted by Allferrys is considered lawful. Access outside of this is illegal. The database and the information contained in the database may not be copied, transferred to other databases and made available to third parties for access and use without Allferrys' prior written consent.

3.6. It is forbidden to intensively extract information from the database in order to obtain the content accessed and / or viewed through the platform. Allferrys may exercise its legal rights to punish persons who do not comply with this prohibition in accordance with applicable legislation for "unauthorized access to the information system".

3.7. Allferrys makes no warranties regarding the service it provides. The Platform and its content are provided on an "as is" basis. Allferrys shall not be liable for any loss or damage caused by failure, error, cancellation or delay of any voyage, interruption of communication, computer virus. Users agree in advance that Allferrys reserves the right to prevent entry and to impose any sanctions, including but not limited to, if they violate the rules and obligations listed in these Ferry Terms of Use.

3.8. Allferrys, together with Allferrys' partners, employees or content providers, cannot be held responsible for possible errors or unintentional omissions, defects or lack of information, interruptions or delays incurred by Users that may occur on the Platform, regardless of the cause and duration. All these organizations or persons do not accept liability for third party claims for damages or losses, punitive damages or consequential damages.

3.9. Allferrys may provide links and/or referrals to other websites through the Platform. Allferrys may publish advertisements and/or application forms for various services of contracted third parties, and may direct Users to the websites of advertisers or third parties through these forms and advertisements. The presence of these links does not indicate that the content of other sites and pages is controlled by Allferrys. Allferrys is not responsible for the privacy practices, content of other websites accessed through this link, or the privacy policies and practices of third parties. Allferrys is not responsible for the content that can be accessed through these links, and Allferrys is not responsible for any damages arising from the actions to be taken on other websites accessed. When users access other websites using these links, they accept in advance that they are responsible.

3.10. All responsibility for the transactions made by the Users on the Platform belongs to the relevant User. Membership and/or purchase transactions may be viewed by third parties using the said computer, especially in cases where Users use a shared computer, but not limited to this. Users should pay maximum attention to this situation.

3.11. Subscription to the Platform is for personal use. Members have the option of obtaining more information about the services and opting out of membership. Members can change or update their membership preferences or membership information at any time. Members can also close their membership accounts at any time.

3.12. Ferry Terms of Use and other texts on the Platform are automatically terminated when the Platform is closed by Allferrys for any reason. To the extent that Allferrys is authorized to change its business, commercial partnership and domain name, and to carry out the same activity over another domain name, these changes will not have any effect on the Ferry Terms of Use.

4.        General rules

4.1. The user accepts and undertakes that he is responsible for the content and accuracy of the passenger information he enters on the Platform, that no changes can be made after entering the information into the system, and that he is solely responsible in case of any related damage.

4.2. The User agrees and undertakes that Allferrys will not be responsible for any disputes, damages and/or claims that may arise between the bus companies and the User in the services offered by Allferrys, and that the only communication channel is the actual provider of the relevant service.

4.3. The user accepts and undertakes that Allferrys does not make any commitments about the accuracy or completeness of the content received from the transport companies and/or intermediary institutions, and that Allferrys is not responsible for any loss of connection or any communication interruption that may occur due to internet infrastructure and telecommunication providers. .

4.4. The User agrees and undertakes that Allferrys has taken the utmost care to ensure the accuracy of the information announced on the Platform, obtained from the suppliers and/or intermediary institutions, but that Allferrys cannot be held responsible if the service received or requested does not show the specified quality and place availability.

4.5. The User accepts and undertakes that the Service is personally or under the control of the relevant transport companies and/or intermediary institutions, and that the rules and conditions of the relevant transport company are valid for the declarations regarding the content in Allferrys.

4.6. Allferrys acts as an intermediary between the User and the transport company in the services it provides. The user accepts and undertakes that he cannot be held responsible for any problems that may occur in the services mediated by Allferrys. In addition, Allferrys or its contracted agents will not be held liable if the ferry ticket cannot be made due to the voyage rules and restrictions of the transport company from which the ferry ticket is purchased.

4.7. The user will be able to block the flight for the tickets purchased through Allferrys' sales channels; We accept that Allferrys will not be responsible for any problems that may occur due to reasons beyond our will, such as any national or international political event, strikes and public movements, minimum number of passengers, overbooking, natural events that may affect the activity of the expedition area, unavailability of ground conditions, and technical disruptions, and commits.

4.8. The User agrees and undertakes that Allferrys will not be liable for any force majeure, extraordinary circumstances, accident or similar events that may occur before/after the flight or during the flight for the ticket purchased through Allferrys' sales channels.

4.9. While making a purchase on the Platform, the User shall provide his/her name, telephone number, T.C. must correctly enter the ID number, e-mail address, credit or debit card number, expiration date of the card and the information requested through the Platform. The user accepts and undertakes that Allferrys will not be held responsible for any disruption that may occur due to the fact that this information is not provided correctly or completely. Allferrys will send an electronic message to the contact details entered by the User at the time of purchase in order to inform the User about the service provided.

4.10. Payments will be made by credit or debit card for all purchases made through Allferrys. The user accepts and undertakes that the bank or credit card used for payment must be a member of the 3D Secure system. 3D Secure declares that the responsibility for transactions carried out with this system is solely on the User, since it provides transactions with a full verification method through its own system, and therefore, it cannot object to expenditures for payments made on the Platform. The user agrees that Allferrys is not responsible for any malfunctions that may occur due to 3D Secure.

4.11. A reservation or service purchased on the platform cannot be transferred to another person and name changes cannot be made.

4.12. If the User encounters a refund situation after the services he has purchased through the Platform, he accepts and undertakes that the fee to be refunded will be determined in accordance with the terms of the transport company and / or the intermediary company. This process accepts and undertakes that the refund will be made to the credit or debit card used when purchasing the service, and if necessary, to the account number specified by the user.

4.13. The user, for all the services purchased through the Platform, is loyal to the conditions of the transport company and/or the intermediary company, that the updated information by the transport company is valid if the transport company makes changes in these conditions, and that the different airline companies determine for cancellation/refund and change transactions. accepts and undertakes that applications and fee penalties may occur.

5.        Terms and Conditions for Ferry Tickets and Expeditions

5.1. Unless the User presents a valid passenger ticket purchased through the Platform, he cannot claim any rights regarding the voyage. If the submitted ticket is altered, torn or torn by anyone other than the transport company and/or the intermediary company, it will lose its validity. The user can purchase discounted tickets if they meet the conditions specified by the transport company and/or Allferrys. Traveling with a discounted ticket is subject to presenting the discounted passenger ticket and the document to qualify for the discount at the terminal. The User who does not present the discounted pass and the required document will have to pay the difference in fare at the terminal counter.

5.2. Baggage other than hand baggage, which the User carries with him during the trips, must be placed in the sections specified by the transport company and/or the vehicle company. Allferrys cannot be held responsible for any damage and/or loss that may occur to the User's baggage during the voyage, regardless of its source and cause, and for any damages, additional costs and liabilities that may arise as a result.

5.3. Users who purchase tickets at a discounted fare tariff are obliged to have their identity cards and similar documents proving that they are eligible to purchase tickets under these conditions at the terminal. The relevant User is responsible for the penalty and fee difference that may arise in case they fail to submit the required document in this regard.

5.4. After the payment is made, the flight will be considered as finalized. Cancellations and changes that you will make in the reservation record and/or ferry ticket will be processed in accordance with the rules and conditions of the relevant transport company. The user accepts, declares and undertakes that he/she is obliged to comply with the written rules and notify these rules to the passengers with whom he/she has made a reservation or purchased tickets, and that Allferrys is not responsible for any complaints and grievances that may arise otherwise.

5.5. Children under the age of 10 (ten) cannot travel without a companion. Children over the age of 6 (six) are required to travel in a separate seat, and a separate ticket is required for these children. Age restrictions for child passengers may vary according to the rules and/or conditions determined by the transport company. You can access detailed information on the websites of the relevant transport company. In the event of any dispute, the carrier's rules will apply and Allferrys has no responsibility in the event of a dispute.

5.6. Admission of unaccompanied children, Users in need of assistance, pregnant women or Users with illness may be subject to regulations by the transport company. In order for Disabled Users to travel, an adult accompanying person must be present and the accompanying person must purchase a passenger ticket. You can access detailed information on the websites of the relevant transport company. In the event of any dispute, the carrier's rules will apply and Allferrys has no responsibility in the event of a dispute.

5.7. Admission of pets is subject to the regulations of the transport company. Regardless of its source and reason, Allferrys cannot be held responsible for the problems that may occur in the health status of the pets carried by the User during the voyage and the related demands and / or the rejection of pets on the voyage.

5.8. Users must be present at the departure terminal 15 minutes before the flight departure time. If the User is not present at the terminal 15 minutes before the departure time, the User may lose his right to travel if he cannot join the flight due to the density of the terminal area and/or other reasons. Arrangements for being at the terminal a certain time before the departure time may vary depending on the conditions of the transport company and/or the intermediary company. Allferrys is not responsible for any dispute.

5.9. A ticket purchased for any trip is only valid for the trip written on it. Tickets not used on time will be invalid and the User will not be able to claim any rights regarding the ticket in question.

5.10. Allferrys cannot be held responsible for malfunctions, accidents, losses that may occur in terminals or ferries, regardless of their source and cause, and for any damage, loss, additional costs and liabilities that may arise as a result.

5.11. For ferry tickets, baggage weight rights and baggage carriage conditions determined by the transport companies are valid according to the destination. Transport companies will charge an extra fee if the kg right they have determined is exceeded, and they may refuse to carry the baggage in question within the framework of the determined rules. Allferrys is not responsible for any problems that may occur between transport companies and Users due to baggage.

5.12. transport companies; for security reasons or at its discretion, refuse to transport Users and/or User luggage and/or User vehicle. In the event of any dispute, the carrier's rules will apply and Allferrys has no responsibility in the event of a dispute.

6.        Carrier Services

6.1. Allferrys provides platform services for the sale of tickets for ferry and passenger transportation services provided by carrier companies through the Platform. In this context, Allferrys is not responsible for the carrier companies not providing the services they undertake to provide and/or the problems arising from the carrier companies. Similarly, in accordance with the ticket sales policies of the carrier companies and the agreements made, Allferrys cannot refund the price of a sold ticket and, if purchased, the service fee. 6.2. For payments made through Allferrys sales channels, refundable tickets are only made to the card used for ticket purchases. In case the expiry date of the card used in the payment has passed or has been cancelled; 
- If the cardholder uses another card of the same bank, a refund will be made to the cardholder's account. 
- If the cardholder has stopped working with the bank, he must apply to the Call Center with an official letter from the bank.

7.        Protection of Personal Data and Privacy

7.1. Allferrys undertakes to take all necessary measures to keep personal data and customer information confidential and in accordance with applicable legislation. For more information on personal data, please read the Clarification Text on the Protection of Personal Data.

7.2. Allferrys, in cases where it is necessary to comply with the obligations arising from the current legislation, in cases where information is requested in line with a research or investigation conducted by the authorized administrative and/or judicial authorities in accordance with the rules of law and procedure, and/or when it is deemed necessary to provide information regarding the protection of the security of the Visitors, visit, shopping and similar necessary information can be shared with third parties.

8.        General provisions

8.1. The law of the Republic of Turkey will be applied in the implementation and interpretation of these Ferry Terms of Use and in the management of legal relations arising within these Terms of Use. Istanbul (Central) Courts and Execution Offices are authorized in case of any dispute arising or to arise due to these Ferry Terms of Use.

8.2. Allferrys Ferries is not legally responsible for late performance and/or non-performance of any of its obligations arising from the Ferry Terms of Use, in all cases deemed legal force majeure. These and similar cases shall not be deemed as delay, non-performance or default for Allferrys, or Allferrys shall not be liable to compensate the Users for any damages for these cases. The term force majeure shall be interpreted as events beyond the reasonable control of Allferrys and/or the carrier companies that will provide transportation service in line with the purchased ticket and which it cannot prevent despite showing due diligence. In this context, but not limited to these, situations such as natural disasters, riots, wars, strikes, epidemics, communication problems, infrastructure and internet failures and/or interruptions, power cuts and bad weather conditions and/or administrative decisions are also considered as force majeure. .

8.3. Notifications to be made to Users in case of purchasing a ticket will be made via the e-mail addresses and/or phone numbers they enter in the relevant sections of the Platform. Allferrys shall not be liable for failure to notify visitors and/or Members due to incorrect contact information.

8.4. Users make their preferences regarding commercial electronic message notifications to be contacted by Allferrys while subscribing to the Platform and/or purchasing tickets. Members can always change their communication preferences from the relevant section of the Platform. Visitors who use the Platform without being a member can always convey their communication preferences to Allferrys via e-mail, telephone or similar methods.

8.5. The parties accept that the books and records, computer records, confirmed fax messages and e-mails belonging to the parties in disputes that may arise from the Ferry Terms of Use are valid and have the quality of evidence.

8.6. The failure of Allferrys to exercise and/or late use of its rights arising from these Ferry Terms of Use and/or applicable legislation shall not be interpreted as a waiver of such right.

9.        Enforcement and Communication

9.1. These Terms of Use have been accepted by Allferrys by purchasing a ferry ticket by the User. According to Article 20 of the Regulation on Distance Contracts, which entered into force within the framework of the Law on the Protection of Consumers numbered 6502, Allferrys is a company that mediates the establishment of a distance contract on behalf of the seller or supplier by using or making available remote communication tools within the framework of the system it has created. According to the Distance Contracts Regulation, sellers and providers are directly responsible to the consumer in the provision of transportation and accommodation services and in providing the necessary information.

9.2. In this context, the User; It accepts in advance that the rules and conditions determined by the transport service provider are valid for the tickets purchased through the platform.
